1. Acceptance of these terms
These Terms of Use apply to your use of this website operated by MEGHA Marine Services. By using the website, you agree to be bound by these terms. If you do not agree, do not use the website.
These terms govern website use only. A quote, work order, service agreement, brokerage appointment, sale agreement or other written agreement may contain additional or different terms for a particular transaction. If there is an inconsistency, the transaction-specific agreement governs to the extent of that inconsistency.
2. General website information
Website content is provided for general information about our services, capabilities, projects, service areas and vessels offered for sale. It is not engineering, survey, safety, legal, financial, insurance or other professional advice for your particular circumstances.
Marine conditions, vessel condition, availability, parts, port access, timing and regulatory requirements can change. Do not rely on general website content as a substitute for an inspection, written quotation, technical assessment or other advice appropriate to the decision you are making.
3. Services, availability and quotes
Descriptions of services on this website do not constitute a binding offer to perform work. A service engagement is formed only when the parties agree the applicable scope, price or pricing basis, timing and other material terms.
Any estimate, indicative timing or availability stated on the website is subject to confirmation. Weather, vessel access, port or marina requirements, parts availability, third-party dependencies and safety considerations may affect performance.
For consumer-facing services, advertised prices will be presented in the manner required by applicable Australian law, including GST and unavoidable charges where required. A written quote or agreement will explain any permitted variable or contingent amounts.
4. Vessel listings and brokerage information
Vessel listings may include information and photographs supplied by owners, sellers or other authorised persons. We may review and edit listing material for clarity and presentation, but we do not guarantee that every seller-supplied statement has been independently verified.
Specifications, equipment, condition, service history, registration status, asking price and availability should be confirmed before you make a purchase decision. Prospective buyers should carry out appropriate due diligence, which may include physical inspection, sea trial, independent marine survey, mechanical or electrical assessment, finance and insurance checks and relevant registration or Personal Property Securities Register searches.
A listing is an invitation to make further enquiries unless expressly stated otherwise. A vessel may be sold, withdrawn, repriced or otherwise become unavailable without prior notice.
5. Seller submissions
Submitting a vessel through the website does not guarantee that we will accept or publish a listing and does not, by itself, appoint us as your broker or agent. Brokerage services, commission, exclusivity, authority to negotiate or sell and other agency terms must be agreed separately.
Vessel submissions are also subject to our Sell a Boat Submission Terms.
6. Australian Consumer Law and other non-excludable rights
Nothing in these Terms of Use excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights that may arise under the Australian Consumer Law.
Where the Australian Consumer Law applies to services we supply, consumer guarantees may include guarantees that services are provided with due care and skill and, where applicable, are fit for a disclosed purpose and supplied within a reasonable time.
7. Intellectual property and third-party trademarks
Unless otherwise stated, the website design, text, graphics, branding and other content we create are owned by or licensed to Megha Marine Services and are protected by applicable intellectual property laws.
You may view and print reasonable extracts for your personal or internal business use. You must not reproduce, republish, commercially exploit, scrape at scale, remove attribution from, or create misleading derivatives of our content without permission, except where the law permits.
Third-Party Trademarks, Brand Names and Membership Logos: All third-party trademarks, service marks, trade names, brand names, product logos, membership badges, accreditation emblems, and industry association identifiers displayed on this website (including, without limitation, the Boating Industry Association of Victoria / BIAV, equipment and engine manufacturers, marine parts brands, and classification or certification bodies) are the exclusive property of their respective owners. Megha Marine Services does not own or claim proprietary rights in any such third-party marks or logos.
Their display on this website is for informational reference, factual identification of parts or equipment, and verification of genuine industry membership, insurance status, or professional accreditation only. Display does not imply endorsement, sponsorship, or affiliation beyond our verified membership status or factual commercial relationship. Rights in vessel images, parts diagrams, or other supplier and seller materials remain with their respective owners or licensors.
8. Acceptable use
You must not use the website to:
- break any law or infringe another person’s rights;
- submit false, misleading, defamatory, unlawful or unauthorised content;
- introduce malware, attempt unauthorised access, probe security controls or interfere with website operation;
- use automated scripts, bots, spiders, or scrapers to access forms, harvest data, submit spam, or bypass bot-detection challenges (such as Cloudflare Turnstile);
- impersonate another person or misrepresent your authority to act for a vessel owner or business;
- harvest personal information or use website contact details for unlawful or unsolicited messaging.
9. Third-party websites, services and memberships
The website may link to third-party websites, manufacturers, suppliers, industry associations, mapping tools or other external services. A link, brand reference, or membership emblem does not mean we endorse every statement, product, or practice of the third party, nor does it imply ownership of their external platforms.
Independent third parties and membership bodies govern their own terms of use and privacy policies, which apply whenever you visit their websites or engage with their services.
10. Website availability, security and bot protection
We aim to keep the website accurate, secure and available, but we do not promise uninterrupted or error-free access. We may maintain, suspend, change or remove website features where reasonably necessary, including for security, maintenance or legal reasons.
To protect website integrity, prevent automated spam, and defend our public forms, we implement automated security and bot-detection services, including Cloudflare Turnstile. We reserve the right to challenge, filter, or reject automated or non-human submissions that fail security validation.
11. Liability for website use
To the extent permitted by law and subject to the non-excludable rights described above, we are not responsible for loss caused solely by relying on unconfirmed general website information where it would have been reasonable to obtain transaction-specific confirmation, inspection or advice.
We do not exclude liability to the extent that doing so would be unlawful or would make a term unfair or unenforceable under applicable law.
12. Changes to these terms
We may update these Terms of Use when our website, services or legal requirements change. The current version is the version published on this website. Changes do not retrospectively alter a separate transaction agreement unless that agreement allows it and the law permits.
13. Governing law
These website Terms of Use are governed by the laws in force in Victoria, Australia. Subject to any mandatory rights or jurisdiction that applies, the courts of Victoria and courts entitled to hear appeals from them have jurisdiction in relation to these terms.
