1. Purpose of these terms
These terms apply when you submit information, photographs or documents about a boat or other vessel to Megha Marine Services for brokerage consideration or a proposed website listing.
They do not replace a later brokerage, agency, consignment, marketing or sale agreement. If we agree to act as broker or agent, the commercial terms of that engagement must be recorded separately.
3. Accuracy and material information
You must provide information that is accurate and not misleading to the best of your knowledge. You must not deliberately omit a fact where the omission would make the information you provide misleading.
You should promptly tell us if material details change, including ownership, registration, condition, equipment, location, asking price, damage, insurance status, finance or security interests, or availability for sale.
We may ask for supporting information before accepting or continuing a listing. We may correct formatting or obvious errors, but you remain responsible for the accuracy of information you supply.
4. Photographs, documents and other content
You retain ownership of content you own. By submitting content, you grant Megha Marine Services a non-exclusive, royalty-free licence to copy, resize, crop, format, store and use that content to:
- assess the proposed listing;
- prepare, publish and promote an agreed vessel listing on our website and ordinary marketing channels;
- communicate with genuine prospective buyers and service providers involved in the listing;
- retain reasonable records for legal, dispute, security and business-administration purposes.
The licence lasts only for those purposes. Public marketing use ends when the listing ends, subject to reasonable technical removal time and lawful archival or record-keeping requirements.
You confirm that you own the submitted content or have permission to give us these rights. Do not submit photographs or documents that unlawfully disclose another person’s private information, infringe intellectual property rights, or contain unlawful material.
Third-Party Trademarks and Brand Names: Vessel specifications, descriptions, and photographs frequently contain third-party trade names, brand names, logos, or model designations (such as boatbuilders, engine manufacturers, and marine electronics brands). All such trademarks and logos remain the exclusive property of their respective owners. Their inclusion in seller submissions and listing descriptions is for descriptive identification of the vessel and its installed equipment only, and does not claim ownership or imply any endorsement or sponsorship by those brand owners.
5. Personal information and publication
We handle personal information in accordance with our Privacy Policy. Vessel submission details are used to assess and manage the potential brokerage relationship, communicate with you and, if accepted, prepare the listing.
We do not publish your private phone number, email address, residential address or identity documents merely because you submit a vessel. If publication of personal information is proposed, we will have an appropriate reason and authority before doing so.
If you provide information about another individual, you must have a lawful basis or appropriate authority to provide it and, where required, make that person aware of the disclosure.
6. Assessment, verification and publication
A submission is a request for assessment, not an acceptance of the vessel for brokerage. We may decline a submission, request further information, or decide not to publish a listing.
We may conduct reasonable checks or ask for documents concerning identity, ownership, registration, specifications, condition or title before publication. Any verification we perform is for our own business and compliance purposes and is not a substitute for a buyer’s independent due diligence.
To defend against automated spam, fraudulent submissions, and system abuse, our vessel submission forms are protected by automated bot-detection technologies, including Cloudflare Turnstile.
7. No brokerage appointment or fee merely by submitting
Submitting the form does not by itself appoint Megha Marine Services as your exclusive or non-exclusive broker, authorise us to bind you to a sale, create a power of attorney, or make any commission or brokerage fee payable.
Any brokerage appointment, authority to negotiate, commission, advertising fee, exclusivity period, minimum sale price, sale process or other commercial term must be separately agreed.
8. Ownership, finance and security interests
Before a vessel is marketed or sold, you must disclose any mortgage, finance arrangement, security interest, lien, joint ownership, court order or other restriction that could affect your ability to transfer good title.
You must not represent that a vessel is free of encumbrances unless that is accurate. Where appropriate, buyers should conduct their own registration and Personal Property Securities Register checks and obtain professional advice.
9. Content removal and withdrawal
We may refuse, suspend or remove submitted content or a listing where reasonably necessary because information appears inaccurate, authority is disputed, content may infringe rights, the vessel is no longer available, a legal or safety concern arises, or continued publication could mislead users.
You may ask to withdraw a submission that has not yet become subject to a separate brokerage agreement. If a brokerage agreement is later signed, its termination and withdrawal terms govern the listing.
10. Australian Consumer Law and governing law
Nothing in these terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including any rights under the Australian Consumer Law that apply to you.
These submission terms are governed by the laws in force in Victoria, Australia. Subject to mandatory rights or jurisdiction, Victorian courts and courts hearing appeals from them have jurisdiction.
